The overall legislation is Regulation (EC) No 1935/2004 - on materials and products intended to come into contact with food, see link at the bottom of the page under "More information". Both manufacturers of materials and products and food business operators are covered by this. The regulation states that the material under intended conditions of use must not transfer substances to the foodstuff in such quantities that it:
represents a risk to human health,
results in an unacceptable change in the composition of the food, or
causes a deterioration of the taste and smell properties of the food
Consumers must also not be misled by the way in which a material or product is labeled, marketed and presented. All manufacturers and importers of materials and products as well as the food business operators who use materials and products in their food production must have a traceability system one step back and one step forward in the supply chain, except when selling directly to the consumer. This is to facilitate control and recall of defective products.
